Fun post. Presumably this points in the direction of looking at the finance as a model of liability sharing. Looks highly likely that the most promising systems will be based on complex liability sharing. Perhaps something of the flavor:
user/ direct perpetrator of harm liable up to seizable net worth
some industry level insurance scheme, similar to FDIC in finance liable for any extra harm
very high safety standards in law for vendors in sector
each episode of harm triggers detailed investigation of vendor involved in harm. If compliance failures with vendor safety regime discovered very large fines imposed. This should preserve incentives for safety in the face of liability cost being socialized at the industry level.
