“Free will” could be described as a matter of whether actions are based on some sort of mental preference calculation the person is at least tangentially aware of, what sorts of factors appear in that calculation, and how much influence particular factors have on the outcome. Punishing someone for behavior when there clearly wasn’t any calculation open to influence through negative incentives involved doesn’t make much sense.
Ideally (if everyone was perfectly rational and perfectly transparent) the only punishment needed would be counter-factual.
